An agreement whereby the Franchisor grants to the Franchisee, who accepts, a non-transferable non-exclusive right, subject to payment by the Franchisee of the Entry Fee and Service Fee to:<\/p>\n

(i) establish and operate a Store in accordance with and based on the Store Concept ; and<\/p>\n

(ii) act in that Store (and in that Store only) as the Franchisor\u2019s franchisee for the promotion and sale of the respective Products, in the name and for the account of the Franchisee, in accordance with and based on the Marketing Concept ; and<\/p>\n
