{"id":32933,"date":"2022-02-21T19:52:31","date_gmt":"2022-02-21T17:52:31","guid":{"rendered":"https:\/\/www.e2.law\/?post_type=legalconcepts&#038;p=32933"},"modified":"2022-02-22T13:27:46","modified_gmt":"2022-02-22T11:27:46","slug":"time-credit-with-justification","status":"publish","type":"legalconcepts","link":"https:\/\/www.e2.law\/en\/legalconcepts\/time-credit-with-justification\/","title":{"rendered":"Time credit with justification"},"content":{"rendered":"<h1>What is time credit?<\/h1>\n<p>Time credit gives workers in the private sector<strong> the option to take a career break &#8211; in whole or in part &#8211;<\/strong> for a certain period of time for one of the reasons provided for in the regulations.<\/p>\n<p>It is a possibility offered by the employer, not a right. The employee who wishes to benefit from time credit must obtain the agreement of his employer. The agreement must cover the principle of the time credit, but also the form of the break, its starting date and its duration.<\/p>\n<p>If the conditions for access are met, the worker can benefit from a &#8220;interruption allowances&#8221; in order to compensate for the loss of salary. These allowances are flat-rate. The scales can be consulted on the <a href=\"https:\/\/www.onem.be\/fr\/documentation\/montants-baremes\/interruption-de-carriere-credit-temps#16137\">National Employment Office website<\/a>.<\/p>\n<h1>Justifications<\/h1>\n<p>There are six justifications for time-credit, divided into two categories: time-credit for caring for a relative (reasons 1 to 5) and time-credit for training (reason 6).<\/p>\n<ol>\n<li><strong>To look after a child under 8 years of age.<\/strong><\/li>\n<li><strong>Palliative care.<\/strong><br \/>\n<em>This reason allows a worker to provide palliative care to a person at the end of life, suffering from an incurable disease in terminal phase.<\/em><\/li>\n<li><strong>To look after of a seriously sick relative.<\/strong><br \/>\n<em>This reason allows a worker to care for a member of his\/her family or household who is suffering from a serious health problem.<\/em><\/li>\n<li><strong>To look after a child under 21 years of age with a disability.<\/strong><\/li>\n<li><strong>To look after of a seriously sick child<\/strong> or a seriously ill minor child in his\/her household.<\/li>\n<li><strong>Following a recognised training course.<\/strong><\/li>\n<\/ol>\n<h1>Forms of interruption<\/h1>\n<ol>\n<li><strong>Total suspension.<\/strong> It allows a worker to take a full time career break<br \/>\n<span style=\"text-decoration: underline;\">Who is it for?<\/span> All workers, regardless of whether they work full-time or part-time.<\/li>\n<li><strong>Reduction by 1\/2.<\/strong>This allows a worker to temporarily reduce working hours with 50%\u00a0.<br \/>\n<span style=\"text-decoration: underline;\">Who is it for?<\/span> Only for workers who are employed at least \u00be time by the employer with whom they wish to reduce their benefits.<\/li>\n<li><strong>Reduction by 1\/5th.<\/strong> This allows a worker to temporarily reduce working hours with 20%.<br \/>\n<span style=\"text-decoration: underline;\">Who is it for?<\/span> For all full-time workers.<\/li>\n<\/ol>\n<div class=\"accordian fusion-accordian\" style=\"--awb-border-size:1px;--awb-icon-size:13px;--awb-content-font-size:16px;--awb-icon-alignment:left;--awb-hover-color:#f9f9f9;--awb-border-color:#cccccc;--awb-background-color:#ffffff;--awb-divider-color:#e0dede;--awb-divider-hover-color:#e0dede;--awb-icon-color:#ffffff;--awb-title-color:#333333;--awb-content-color:#747474;--awb-icon-box-color:#333333;--awb-toggle-hover-accent-color:#0da74c;--awb-title-font-family:&quot;Roboto Slab&quot;;--awb-title-font-weight:300;--awb-title-font-style:normal;--awb-title-font-size:14px;--awb-content-font-family:&quot;PT Sans&quot;;--awb-content-font-style:normal;--awb-content-font-weight:400;\"><div class=\"panel-group fusion-toggle-icon-boxed\" id=\"accordion-32933-1\"><div class=\"fusion-panel panel-default panel-48b5a2f39b50380b0 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_48b5a2f39b50380b0\"><a aria-expanded=\"false\" aria-controls=\"48b5a2f39b50380b0\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-32933-1\" data-target=\"#48b5a2f39b50380b0\" href=\"#48b5a2f39b50380b0\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Legal basis<\/span><\/a><\/h4><\/div><div id=\"48b5a2f39b50380b0\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_48b5a2f39b50380b0\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<ul>\n<li><strong>Time credit with the employer<\/strong>: <a href=\"http:\/\/www.cnt-nar.be\/CCT-COORD\/cct-103-(01).pdf\">collective labour agreement n\u00b0103 of 27 June 2012<\/a><\/li>\n<li><strong>Entitlement to interruption allowances<\/strong>: <a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/change_lg.pl?language=fr&amp;la=F&amp;cn=2001121237&amp;table_name=loi\">Royal decree of 12.12.2001<\/a>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><\/div><\/div><\/div><\/div><\/div>\n","protected":false},"featured_media":0,"template":"","categories":[1],"tags":[905,904,906],"class_list":["post-32933","legalconcepts","type-legalconcepts","status-publish","hentry","category-uncategorized","tag-career-break","tag-time-credit","tag-time-credit-with-justification"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
