{"id":32937,"date":"2022-02-22T11:09:56","date_gmt":"2022-02-22T09:09:56","guid":{"rendered":"https:\/\/www.e2.law\/legalconcepts\/le-conge-parental\/"},"modified":"2022-02-22T13:25:29","modified_gmt":"2022-02-22T11:25:29","slug":"parental-leave","status":"publish","type":"legalconcepts","link":"https:\/\/www.e2.law\/en\/legalconcepts\/parental-leave\/","title":{"rendered":"Parental leave"},"content":{"rendered":"<h1>What is parental leave ?<\/h1>\n<p>Parental leave is a thematic leave that allows a worker to interrupt his\/her career, totally or partially, to take care of his\/her young child(ren).<\/p>\n<p>It is a right that the employer cannot refuse if the worker meets the conditions of access provided for by the regulations. <em>However, in certain cases, the employer may postpone the start of the leave for a maximum of 6 months.<\/em><\/p>\n<p>The worker may receive an interruption allowance from the NEO. This allowance is a lump sum. The scales can be consulted on <a href=\"https:\/\/www.onem.be\/fr\/documentation\/montants-baremes\/interruption-de-carriere-credit-temps#16311\">the NEO website<\/a>.<\/p>\n<p>Access conditions<\/p>\n<ul>\n<li><strong>Status<\/strong><br \/>\nAll employees working for an employer subject to Belgian law whose remuneration is subject to social security contributions.<\/li>\n<li><strong>Length of service with the employer.<\/strong>\n<ul>\n<li>Private sector: be bound by an employment contract with the employer for 12 of the 15 months preceding the application.<\/li>\n<li>Public sector or education: no seniority requirement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>Relationship to the child<\/strong><br \/>\nBe related to the child for whom the interruption is requested.<br \/>\n<em>This applies to:<\/em><\/p>\n<ul>\n<li><em>the mother and the biological father<\/em><\/li>\n<li><em>the person who recognised the child so that paternal filiation is established<\/em><\/li>\n<li><em>the wife or partner of the biological mother who has become a co-mother<\/em><\/li>\n<li><em>the adoptive parents.<\/em><\/li>\n<\/ul>\n<\/li>\n<li><strong>Age of the child <\/strong>\n<ul>\n<li>12 years old maximum<\/li>\n<li>21 years if the child is disabled<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<h1>Forms of interruption<\/h1>\n<ul>\n<li><strong>Complete break.<\/strong><br \/>\nOpen to all workers.<\/li>\n<li><strong>Half-time break<\/strong>.<br \/>\nOpen to all workers in full-time employment.<\/li>\n<li><strong>Interruption of one fifth.<\/strong><br \/>\nOpen to all full-time workers.<\/li>\n<li><strong>Interruption of one tenth.<\/strong><br \/>\nOpen to all full-time workers.<\/li>\n<\/ul>\n<p>Partial breaks require the agreement of the employer.<\/p>\n<h1>Maximum duration<\/h1>\n<ul>\n<li><strong>Full break:<\/strong> maximum 4 months (or 16 weeks if split).<\/li>\n<li><strong>Half-time break<\/strong>: maximum 8 months.<\/li>\n<li><strong>Interruption of one fifth<\/strong>: maximum 20 months.<\/li>\n<li><strong>Interruption of one tenth:<\/strong> maximum 40 months.<\/li>\n<\/ul>\n","protected":false},"featured_media":0,"template":"","categories":[1],"tags":[915,916,917],"class_list":["post-32937","legalconcepts","type-legalconcepts","status-publish","hentry","category-uncategorized","tag-leave","tag-parental-leave","tag-thematic-leave"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
