C&#8217;est ce qu&#8217;on appelle le &#8220;ruling social&#8221;. Elle recueille des avis relatif \u00e0 la nature des relations de travail dans un secteur ou une profession en particulier. Elle \u00e9labore ainsi des crit\u00e8res sp\u00e9cifiques au secteur ou \u00e0 la profession en question, qui compl\u00e8te les crit\u00e8res g\u00e9n\u00e9raux, et la soumet au ministre comp\u00e9tent.D&#8217;initiative ou \u00e0 la demande d&#8217;un ministre, elle peut \u00e9galement rendre des rapports sur l&#8217;existence ou l&#8217;absence de probl\u00e9matique quant \u00e0 la nature des relations de travail dans un secteur ou une profession.<\/li>\n<li><strong>Chambre administrative<\/strong>. Elle se prononce sur la qualification de la relation de travail dans les cas concrets qui lui sont soumis \u00e0 la demande conjointe ou unilat\u00e9rale des parties de cette relation de travail. C&#8217;est ce qu&#8217;on appelle le ruling social.<\/li>\n<\/ol>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-4f8b10ebd0a679c7e fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_4f8b10ebd0a679c7e\"><a aria-expanded=\"false\" aria-controls=\"4f8b10ebd0a679c7e\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-31674-1\" data-target=\"#4f8b10ebd0a679c7e\" href=\"#4f8b10ebd0a679c7e\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Proc\u00e9dure<\/span><\/a><\/h4><\/div><div id=\"4f8b10ebd0a679c7e\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_4f8b10ebd0a679c7e\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>La Chambre administrative de la Commission peut \u00eatre saisie :<\/p>\n<ol>\n<li>\u00e0 l\u2019initiative conjointe des parties \u00e0 la relation de travail ;<\/li>\n<li>\u00e0 l\u2019initiative de toute partie qui envisage d\u2019avoir une relation \u00a0de travail avec une autre partie et dont le statut de travailleur salari\u00e9 ou de travailleur ind\u00e9pendant est incertain et en fait la demande directement \u00e0 la Chambre administrative de la Commission ; et<\/li>\n<li>\u00e0 l\u2019initiative d\u2019une seule partie dans le cas o\u00f9 celle-ci commence une activit\u00e9 professionnelle de travailleur ind\u00e9pendant et en fait la demande lors de son affiliation \u00e0 une caisse d\u2019assurances sociales.<\/li>\n<\/ol>\n<p>La proc\u00e9dure pour introduire une demande et les formulaires n\u00e9cessaires \u00e0 l&#8217;introduction de cette demande se trouvent sur <a href=\"https:\/\/commissionrelationstravail.belgium.be\/fr\/introduire-demande.htm\">le site internet de la Commission<\/a>.<\/p>\n<p>Attention, aucune proc\u00e9dure ne peut \u00eatre introduite si une enqu\u00eate ou une instruction p\u00e9nale a \u00e9t\u00e9 ouverte concernant la nature de la relation de travail ou si\u00a0une juridiction du travail a \u00e9t\u00e9 saisie ou s&#8217;est d\u00e9j\u00e0 prononc\u00e9e sur celle-ci.<\/p>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-a32c61e1c56a47a6a fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_a32c61e1c56a47a6a\"><a aria-expanded=\"false\" aria-controls=\"a32c61e1c56a47a6a\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-31674-1\" data-target=\"#a32c61e1c56a47a6a\" href=\"#a32c61e1c56a47a6a\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">D\u00e9lais<\/span><\/a><\/h4><\/div><div id=\"a32c61e1c56a47a6a\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_a32c61e1c56a47a6a\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>La proc\u00e9dure devant la Chambre administrative est ouverte:<\/p>\n<ul>\n<li>\u00e0 toute personne qui <strong>envisage<\/strong> une relation de travail;<\/li>\n<li>\u00e0 toute personne qui <strong>d\u00e9bute<\/strong> une relation de travail (le cas \u00e9ch\u00e9ant, via la caisse d&#8217;assurance sociale lors de l&#8217;inscription) ; et<\/li>\n<li>\u00e0 toute personne qui<strong> a d\u00e9but\u00e9<\/strong> une relation de travail <strong>depuis moins d&#8217;un an<\/strong>.<\/li>\n<\/ul>\n<p>Si de nouveaux crit\u00e8res sectoriels entre en application, les personnes concern\u00e9es peuvent introduire une nouvelle demande dans l\u2019ann\u00e9e suivant l\u2019entr\u00e9e en vigueur de ces crit\u00e8res.<\/p>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-6b8ea3cf78572db6a fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_6b8ea3cf78572db6a\"><a aria-expanded=\"false\" aria-controls=\"6b8ea3cf78572db6a\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-31674-1\" data-target=\"#6b8ea3cf78572db6a\" href=\"#6b8ea3cf78572db6a\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">D\u00e9cisions rendues<\/span><\/a><\/h4><\/div><div id=\"6b8ea3cf78572db6a\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_6b8ea3cf78572db6a\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>Les d\u00e9cisions de la Commission\u00a0 produisent leur effet pour une dur\u00e9e de 3 ans.<\/p>\n<p>Elles lient les institutions repr\u00e9sent\u00e9es au sein de la Commission (ONSS, INASTI, SPF EMPLOI) ainsi que les caisses d\u2019assurances sociales.<\/p>\n<p>L&#8217;int\u00e9r\u00eat de se soumettre \u00e0 l&#8217;avis de la Commission, c\u2019est qu\u2019en cas de requalification de la relation de travail, la r\u00e9gularisation ne porte que sur les cotisations, sans majoration, ni int\u00e9r\u00eat, ni sanction. Les cotisations vers\u00e9es sous l\u2019ancien statut peuvent \u00e9galement \u00eatre d\u00e9duites.<\/p>\n<p>Les d\u00e9cisions sont susceptibles de recours devant le tribunal du travail dans le mois de leur adoption.<\/p>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-5e8e3b2437ec6285f fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_5e8e3b2437ec6285f\"><a aria-expanded=\"false\" aria-controls=\"5e8e3b2437ec6285f\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-31674-1\" data-target=\"#5e8e3b2437ec6285f\" href=\"#5e8e3b2437ec6285f\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Composition<\/span><\/a><\/h4><\/div><div id=\"5e8e3b2437ec6285f\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_5e8e3b2437ec6285f\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>La Commission est compos\u00e9e de deux chambres, une chambre normative et une chambre administrative.<\/p>\n<p>Les membres qui si\u00e8gent au sein de la Commission sont issus :<\/p>\n<ul>\n<li>du SPF S\u00e9curit\u00e9 sociale ;<\/li>\n<li>du SPF Emploi, Travail et Concertation Sociale ;<\/li>\n<li>de l&#8217;Institut national d&#8217;assurances sociales pour travailleurs ind\u00e9pendants (INASTI);
