formation\u00a0\u00bb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Il faut n\u00e9anmoins respecter certaines conditions\u00a0:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les engagements doivent \u00eatre pris au nom d\u2019une soci\u00e9t\u00e9 en formation\u00a0;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La soci\u00e9t\u00e9 doit \u00eatre constitu\u00e9e et acqu\u00e9rir sa personnalit\u00e9 juridique dans les deux ans \u00e0 dater de l\u2019engagement\u00a0;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La soci\u00e9t\u00e9 doit reprendre ces engagements dans les trois mois de sa constitution.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00c0 d\u00e9faut de respecter ces conditions cumulatives, ceux qui auront pris un engagement au nom d\u2019une soci\u00e9t\u00e9 en formation seront personnellement et solidairement responsables envers le tiers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Exemple\u00a0: J\u2019envisage de constituer ma soci\u00e9t\u00e9 et je souhaite faire appel \u00e0 un <\/span><i><span style=\"font-weight: 400;\">Web developper<\/span><\/i><span style=\"font-weight: 400;\"> pour le site internet.\u00a0 Je signe le contrat au nom de ma soci\u00e9t\u00e9 en formation et je paye les premi\u00e8res factures.
