D\u00e9finition<\/h3>\n<p>Il s&#8217;agit d&#8217;un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e par lequel le patron s&#8217;engage \u00e0 donner ou \u00e0 faire donner \u00e0 l&#8217;apprenti une formation en vue de l&#8217;exercice de la profession choisie et par lequel l&#8217;apprenti s&#8217;oblige \u00e0 apprendre sous l&#8217;autorit\u00e9 du patron la pratique de la profession et \u00e0 suivre sous la surveillance de celui-ci, les cours n\u00e9cessaires \u00e0 sa formation.<\/p>\n<h3>II. Conditions<\/h3>\n<h4>A. Conditions de fond<\/h4>\n<ol>\n<li>Le contrat doit \u00eatre conclu avant les 18 ans de l&#8217;apprenti.<\/li>\n<li>L&#8217;apprenti doit avoir satisfait \u00e0 l&#8217;obligation scolaire \u00e0 plein temps.<\/li>\n<li>Le contrat ne peut \u00eatre conclu que pour les professions d\u00e9termin\u00e9es dans le r\u00e8glement d&#8217;apprentissage sectoriel.<\/li>\n<li>Le patron doit \u00eatre agr\u00e9\u00e9 par le comit\u00e9 paritaire d&#8217;apprentissage comp\u00e9tent, \u00eatre \u00e2g\u00e9 d&#8217;au moins 25 ans et justifier d&#8217;au moins sept ann\u00e9e d&#8217;exp\u00e9rience pratique dans la formation.<\/li>\n<\/ol>\n<h4>B. Conditions de forme<\/h4>\n<p>Le contrat doit \u00eatre r\u00e9dig\u00e9 par \u00e9crit suivant le mod\u00e8le fix\u00e9 par le r\u00e8glement d&#8217;apprentissage sectoriel au plus tard au moment de l&#8217;entr\u00e9e en service de l&#8217;apprenti.<\/p>\n<p>Les l\u00e9gislations applicables pr\u00e9voient toute une s\u00e9rie de mentions obligatoires. En Communaut\u00e9 fran\u00e7aise, c&#8217;est l&#8217;article 7 du <a href=\"https:\/\/etaamb.openjustice.be\/fr\/decret-du-14-juin-2018_n2018031499.html\">D\u00e9cret du 14 juin 2018<\/a>\u00a0qui liste ces mentions.<\/p>\n<h3>III. Dur\u00e9e<\/h3>\n<p>Le contrat d&#8217;apprentissage est n\u00e9cessairement un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e.<\/p>\n<p>La dur\u00e9e du contrat \u00eatre fix\u00e9e dans le r\u00e8glement d&#8217;apprentissage.
