R\u00e9ponse ci-dessous.<\/strong><\/p>\n<p>L&#8217;employeur et le travailleur ont le droit de mettre fin au contrat de travail qui les lie \u00e0 tout moment.<\/p>\n<p>Pour que la notification soit valable, les formes impos\u00e9es par la loi doivent \u00eatre respect\u00e9es.<\/p>\n<h2>I. Modalit\u00e9s de notification<\/h2>\n<h3>A.\u00a0 Forme et mentions obligatoires<\/h3>\n<p>Le pr\u00e9avis doit \u00eatre :<\/p>\n<ul>\n<li>notifi\u00e9 <strong>par \u00e9crit<\/strong> ; et<\/li>\n<li><strong>dat\u00e9<\/strong> et <strong>sign\u00e9<\/strong>.<\/li>\n<\/ul>\n<p>La notification doit contenir deux mentions:<\/p>\n<ul>\n<li>la <strong>date de d\u00e9but<\/strong> du pr\u00e9avis ; et<\/li>\n<li>la<strong> dur\u00e9e<\/strong> du pr\u00e9avis.<\/li>\n<\/ul>\n<p>A d\u00e9faut, le pr\u00e9avis est <a href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/nullite\/\">nul<\/a>.<\/p>\n<h3>B. L&#8217;envoi avec accus\u00e9 de r\u00e9ception n&#8217;est pas n\u00e9cessaire.<\/p>\n<p>La notification est <strong>cens\u00e9e \u00eatre re\u00e7ue le 3e jour ouvrable qui suit la date d&#8217;envoi<\/strong> du recommand\u00e9. Peu importe si le destinataire le refuse ou ne va pas le chercher au bureau de poste.<\/p>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-2d18839230b9ac86e fusion-toggle-has-divider\" style=\"--awb-title-color:#333333;--awb-content-color:#747474;\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_2d18839230b9ac86e\"><a aria-expanded=\"false\" aria-controls=\"2d18839230b9ac86e\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-42858-1\" data-target=\"#2d18839230b9ac86e\" href=\"#2d18839230b9ac86e\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">par exploit d'huissier<\/span><\/a><\/h4><\/div><div id=\"2d18839230b9ac86e\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_2d18839230b9ac86e\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>Le pr\u00e9avis peut \u00eatre notifi\u00e9 par huissier de justice.<\/p>\n<p>Il est <strong>cens\u00e9 \u00eatre re\u00e7u le jour de la signification<\/strong>. Peu importe si le destinaire le refuse ou est absent lors du passage de l&#8217;huissier.<\/p>\n<p>Dans ce cas, l&#8217;huissier d\u00e9posera une copie de la signification dans sa bo\u00eete aux lettres. Il lui adressera ensuite un courrier recommand\u00e9 confirmant la signification.<\/p>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-1dca15676ee4b5038 fusion-toggle-has-divider\" style=\"--awb-title-color:#333333;--awb-content-color:#747474;\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_1dca15676ee4b5038\"><a aria-expanded=\"false\" aria-controls=\"1dca15676ee4b5038\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-42858-1\" data-target=\"#1dca15676ee4b5038\" href=\"#1dca15676ee4b5038\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">par remise de la main \u00e0 la main (pour le travailleur uniquement)<\/span><\/a><\/h4><\/div><div id=\"1dca15676ee4b5038\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_1dca15676ee4b5038\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>Le travailleur peut remettre \u00e0 son employeur sa notification \u00e9crite en double exemplaire.<\/p>\n<p>Il lui demande de <strong>signer le double pour accuser r\u00e9ception<\/strong> du pr\u00e9avis. Si l&#8217;employeur refuse, la notification n&#8217;a pas eu lieu.<\/p>\n<p>Dans ce cas, le travailleur devra recourir \u00e0 l&#8217;un des deux autres modes de notification d\u00e9taill\u00e9s ci-dessus.<\/p>\n<p><\/div><\/div><\/div><\/div><\/div>\n<p>Le pr\u00e9avis qui n&#8217;est pas notifi\u00e9 par l&#8217;un de ces trois modes est <a href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/nullite\/\">nul<\/a> :<\/p>\n<ul>\n<li>de <a href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/nullite-absolue\/\">nullit\u00e9 absolue<\/a> lorsqu&#8217;il est notifi\u00e9 <strong>par l&#8217;employeur<\/strong> ; et<\/li>\n<li>de <a href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/nullite-relative\/\">nullit\u00e9 relative<\/a> lorsqu&#8217;il est notifi\u00e9 <strong>par le travailleur<\/strong>.<\/li>\n<\/ul>\n<h2>II.
