C&#8217;est un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e. Sauf si le preneur en demande le renouvellement, il prend fin \u00e0 l\u2019issue des neuf ans sans autre formalit\u00e9.<\/p>\n<p>Que se passe-t-il lorsque les parties n\u2019ont pas convenu d\u2019un renouvellement dans les formes impos\u00e9es par la loi, mais qu\u2019\u00e0 l\u2019issue de la p\u00e9riode de neuf ans, le preneur reste dans les lieux sans que le bailleur ne s\u2019y oppose ?<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/p>\n<h2 class=\"\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\"><strong>I. La reconduction tacite du bail<\/strong><\/h2>\n<p><a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/loi_a1.pl?language=fr&amp;la=F&amp;table_name=loi&amp;cn=1951043030&amp;&amp;caller=list&amp;F&amp;fromtab=loi&amp;tri=dd+AS+RANK&amp;rech=1&amp;numero=1&amp;sql=(text+contains+(%27%27))#Art.14\">L\u2019article 14, alin\u00e9a 3<\/a> de la loi du 30 avril 1951 sur les baux commerciaux pr\u00e9voit que dans pareille situation, un nouveau bail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e prend cours le lendemain de l\u2019expiration du bail commercial.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/p>\n<h2 class=\"\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\"><strong>II. R\u00e9gime du nouveau bail<\/strong><\/h2>\n<p>La doctrine ne s&#8217;accorde pas sur le r\u00e9gime applicable au nouveau bail. Certains auteurs estiment que le nouveau bail reste soumis \u00e0 la loi sur les baux commerciaux. D&#8217;autres consid\u00e8rent qu&#8217;il est r\u00e9gi au droit commun du bail.<\/p>\n<p>L\u2019enjeu principal de cette question se situe au niveau des conditions applicables \u00e0 une expulsion du preneur par l\u2019acqu\u00e9reur du bien lou\u00e9 en cas de vente de celui-ci.<\/p>\n<p>En effet, si le bail reste soumis \u00e0 la loi sur les baux commerciaux, l\u2019acqu\u00e9reur ne pourra expulser le preneur que si le bail initial pr\u00e9voit express\u00e9ment cette possibilit\u00e9, moyennant le respect de conditions strictes. Il devra \u00e9galement respecter un pr\u00e9avis d\u2019un an <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/p>\n<p>A l\u2019inverse, si l\u2019on consid\u00e8re que le nouveau bail est soumis au droit commun, \u00e0 d\u00e9faut d\u2019enregistrement du bail, l\u2019acqu\u00e9reur du bien pourra expulser le preneur sans pr\u00e9avis. Il pourrait toutefois \u00eatre redevable d&#8217;une indemnit\u00e9 envers le preneur <a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a><\/p>\n<h2 class=\"\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">III. La r\u00e9siliation du nouveau bail<\/h2>\n<p>L\u2019article 14, alin\u00e9a 3 pr\u00e9voit express\u00e9ment que le bailleur pourra mettre fin au nouveau bail \u00e0 tout moment, moyennant un pr\u00e9avis de dix-huit mois.
