\u00e0 construire vis-\u00e0-vis des professionnels de la construction.<\/p>\n<h2>A qui s&#8217;applique-t-elle ?<\/h2>\n<p>Elle s\u2019applique :<\/p>\n<ul>\n<li>aux contrats de vente sur plan ou clef sur porte, aux contrats d&#8217;entrerprise g\u00e9n\u00e9rale et aux contrats de propomotion immobili\u00e8re ;<\/li>\n<li>portant sur des habitations qui sont situ\u00e9es en Belgique ; et<\/li>\n<li>lorsque l&#8217;acheteur est tenu d&#8217;effectuer un ou plusieurs versements avant l&#8217;ach\u00e8vement des travaux.<\/li>\n<\/ul>\n<h2>Que pr\u00e9voit-elle ?<\/h2>\n<\/div><div d&#8217;informations obligatoires :<\/p>\n<ul>\n<li>l&#8217;identit\u00e9 du propri\u00e9taire du terrain,<\/li>\n<li>la date de d\u00e9livrance du permis d&#8217;urbanisme,<\/li>\n<li>le prix total,<\/li>\n<li>les modalit\u00e9s de paiements,<\/li>\n<li>etc.<\/li>\n<\/ul>\n<p>Ces mentions sont list\u00e9es \u00e0 <a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/loi_a1.pl?language=fr&amp;la=F&amp;table_name=loi&amp;cn=1971070930&amp;&amp;caller=list&amp;F&amp;fromtab=loi&amp;tri=dd+AS+RANK&amp;rech=1&amp;numero=1&amp;sql=(text+contains+(%27%27))#Art.7\">l&#8217;article 7 de la loi.<\/a><\/p>\n<p>Certains documents doivent \u00e9galement obligatoirement \u00eatre annex\u00e9s \u00e0 la convention :\u00a0les plans et cahiers des charges d\u00e9taill\u00e9s des travaux par exemple.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-b283f62e19612b8a3 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" fusion-clearfix\">\n<p>La loi pr\u00e9voit une s\u00e9rie de clauses formellement prohib\u00e9es.<\/p>\n<p>Notamment :<\/p>\n<ul>\n<li>les clauses abusives en g\u00e9n\u00e9ral ;<\/li>\n<li>la clause de rachat par laquelle le vendeur se r\u00e9serve de reprendre le bien vendu moyennant restitution du prix ;<\/li>\n<li>les indemnit\u00e9s forfaitaires contractuelles de plus de 5% du prix total ;<\/li>\n<li>etc.<\/li>\n<\/ul>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-b4bf36d3a598ad940 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title 8<\/a> pr\u00e9voit que la Convention doit pr\u00e9ciser le prix total de l&#8217;immeuble. Il doit obligatoirement \u00eatre fixe.<\/p>\n<p>Seul les travaux rendus n\u00e9cessaires par la survenance d&#8217;\u00e9v\u00e8nements impr\u00e9visibles de nature physique peuvent justifier une augmentation de ce prix.<\/p>\n<p>La Convention peut pr\u00e9voir une clause de r\u00e9vision de prix, pour autant qu&#8217;elle soit clairement mentionn\u00e9e.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-2fc5e5e186def4370 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_2fc5e5e186def4370\"><a aria-expanded=\"false\" aria-controls=\"2fc5e5e186def4370\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-33136-1\" data-target=\"#2fc5e5e186def4370\" href=\"#2fc5e5e186def4370\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon fa-minus fas\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-plus fas\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Modalit\u00e9s financi\u00e8res<\/span><\/a><\/h4><\/div><div id=\"2fc5e5e186def4370\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_2fc5e5e186def4370\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p><a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/loi_a1.pl?language=fr&amp;la=F&amp;table_name=loi&amp;cn=1971070930&amp;&amp;caller=list&amp;F&amp;fromtab=loi&amp;tri=dd+AS+RANK&amp;rech=1&amp;numero=1&amp;sql=(text+contains+(%27%27))#Art.10\">L&#8217;article 10<\/a> r\u00e8gle strictement les modalit\u00e9s financi\u00e8res de la Convention.<\/p>\n<ul>\n<li>Le vendeur ne peut exiger ou accepter aucun paiement avant la conclusion du contrat.<\/li>\n<li>Lors de la signature, un acompte peut \u00eatre exig\u00e9 mais il ne peut exc\u00e9der 5% du prix total.<\/li>\n<li>Le solde du prix des travaux est exigible uniquement par tranche. Ces tranches ne peuvent d\u00e9passer le co\u00fbts des ouvrages d\u00e9j\u00e0 ex\u00e9cut\u00e9s.<\/li>\n<\/ul>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-1325807972141eade href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/loi_a1.pl?language=fr&amp;la=F&amp;table_name=loi&amp;cn=1971070930&amp;&amp;caller=list&amp;F&amp;fromtab=loi&amp;tri=dd+AS+RANK&amp;rech=1&amp;numero=1&amp;sql=(text+contains+(%27%27))#Art.12\">L&#8217;article 12 de la loi<\/a> pr\u00e9voit que le vendeur, l&#8217;entrepreneur ou le promoteur est oblig\u00e9 de fournir \u00e0 l&#8217;acqu\u00e9reur des garanties financi\u00e8res :<\/p>\n<ul>\n<li>L&#8217;entrepreneur agr\u00e9\u00e9 a l&#8217;obligation de constituer un cautionnement pour un montant \u00e9quivalent \u00e0 5% du prix du b\u00e2timent.<\/li>\n<li>Si l&#8217;entrepreneur n&#8217;est pas agr\u00e9\u00e9, il doit fournir une double garantie totale d&#8217;ach\u00e8vement ou de remboursement.<br \/>\nUn organisme financier doit se porter caution solidaire pour les sommes n\u00e9cessaires \u00e0 :<\/p>\n<ul>\n<li>l&#8217;ach\u00e8vement total de l&#8217;immeuble ; ou<\/li>\n<li>le remboursement total des sommes vers\u00e9es en cas de r\u00e9solution du contrat.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-e3d982f4666d4e0e6 fusion-toggle-has-divider\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p><a 9 de la loi<\/a> pr\u00e9voit qu&#8217;il doit s&#8217;\u00eatre \u00e9coul\u00e9 un d\u00e9lais d&#8217;un an entre la r\u00e9ception provisoire et la r\u00e9ception d\u00e9finitive des 6<\/a> pr\u00e9voit une extension de la responsabilit\u00e9 d\u00e9cennale des architectes et entrepreneurs pr\u00e9vue aux articles 1792 \u00e0 2270 du Code civil aux vendeurs d&#8217;habitation \u00e0 construire.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-3 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-text fusion-text-3\"><h2>Sanctions<\/h2>\n<p>La violation de dispositions de la loi Breyne entra\u00eenent, selon les cas:<\/p>\n<ul>\n<li>soit la nullit\u00e9 de la clause contraire \u00e0 la loi,<\/li>\n<li>soit la nullit\u00e9 de la convention compl\u00e8te.<\/li>\n<\/ul>\n<p>Le vendeur qui exige ou accepte des paiements en contradiction avec l&#8217;article 10 de la loi, r\u00e9sum\u00e9 ci-dessus, peut \u00e9galement \u00eatre condamn\u00e9 :<\/p>\n<ul>\n<li>au paiement d&#8217;une amende ; ou<\/li>\n<li>\u00e0 une peine d&#8217;emprisonnement,<\/li>\n<\/ul>\n<p>Et ce m\u00eame si la convention est susceptible d&#8217;\u00eatre frapp\u00e9e de nullit\u00e9.<\/p>\n<\/div><div class=\"fusion-text fusion-text-4\"><table border=\"1\" width=\"100%\">\n<tbody>\n<tr>\n<th align=\"center\" width=\"80%\"><span
