Champ d\u2019application de la loi<\/strong><\/h2>\n<p>Les dispositions de la loi du 30 avril 1951 s\u2019appliquent aux immeubles lou\u00e9s et affect\u00e9s \u00e0 l\u2019exercice d\u2019un commerce de d\u00e9tail ou \u00e0 l\u2019activit\u00e9 d\u2019un artisan en contact avec le public <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/p>\n<p>Pour tomber sous le champ d\u2019application de la loi, un bail commercial doit remplir les conditions suivantes :<\/p>\n<ol>\n<li><strong>Existence d\u2019un bail<\/strong>, ce qui suppose la mise \u00e0 disposition d\u2019un bien contre le paiement d\u2019un loyer.<br \/>\nLe bail ne doit pas n\u00e9cessairement \u00eatre \u00e9crit pour entrer dans le champ d\u2019application de la loi.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<li><strong>Portant sur un immeuble (ou une partie d\u2019immeuble).<br \/>\n<\/strong><span style=\"color: #ffffff;\">.<\/span><\/li>\n<li><strong>Affect\u00e9 \u00e0 l\u2019exercice d\u2019un commerce de d\u00e9tail ou \u00e0 l\u2019activit\u00e9 d\u2019un artisan directement en contact avec le public <\/strong><strong>d\u00e8s l\u2019entr\u00e9e en jouissance.<\/strong><br \/>\nLe <u>commerce de d\u00e9tail<\/u> implique l\u2019offre de vente de biens ou de services \u00e0 une client\u00e8le priv\u00e9e et le contact direct avec des consommateurs. <u>L\u2019activit\u00e9 d\u2019artisan<\/u> vise l\u2019activit\u00e9 d\u2019une personne active dans la production, la transformation, la r\u00e9paration, la restauration d\u2019objets, la prestation de services dont les activit\u00e9s pr\u00e9sentent des aspects essentiellement manuels, un caract\u00e8re authentique, d\u00e9veloppant un certain savoir-faire ax\u00e9 sur la qualit\u00e9, la tradition, la cr\u00e9ation ou l\u2019innovation <a href=\"#_ftn2\" name=\"_ftnref2\">[2].<\/a><br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<li><strong>De mani\u00e8re expresse ou tacite<\/strong>. L\u2019affectation du bien doit \u00eatre effective et est r\u00e9alis\u00e9e de commun accord par les parties :<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>\u00e0 l\u2019entr\u00e9e dans les lieux, l\u2019accord peut \u00eatre tacite ;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>en cas de changement d\u2019affectation en cours de bail, l\u2019accord doit \u00eatre expr\u00e8s.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>La loi exclut express\u00e9ment certains types de baux \u00e0 l\u2019article 2 :<\/p>\n<ul>\n<li>les baux normalement consentis pour une dur\u00e9e inf\u00e9rieure \u00e0 un an<\/li>\n<li>les baux portant sur des immeubles exon\u00e9r\u00e9s de l\u2019imp\u00f4t foncier<\/li>\n<li>les baux consentis par un administrateur provisoire<\/li>\n<li>les baux portant sur un immeuble \u00e0 revenus modiques<\/li>\n<li>les baux portant sur des immeubles expropri\u00e9s consentis par l\u2019administration<\/li>\n<\/ul>\n<p>Lorsque le bail n\u2019est pas couvert par la loi, il est soumis au droit commun de la location.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\"><strong>II. Port\u00e9e de la loi<\/strong><\/h2>\n<p>Les dispositions de la loi du 30 avril 1951 sont<strong> imp\u00e9ratives sauf lorsque le l\u00e9gislateur pr\u00e9voit express\u00e9ment le contraire.<\/strong><\/p>\n<p>Par cons\u00e9quent, sauf lorsque le l\u00e9gislateur en pr\u00e9voit express\u00e9ment la possibilit\u00e9, la clause contractuelle qui \u00e9carte une disposition de la loi est r\u00e9put\u00e9e non \u00e9crite et frapp\u00e9e de nullit\u00e9 relative.<\/p>\n<p>Le caract\u00e8re relatif de la nullit\u00e9 implique que les parties peuvent renoncer \u00e0 invoquer la nullit\u00e9 d\u2019une clause. La renonciation peut \u00eatre tacite mais doit \u00eatre certaine.
