Qu&#8217;est-ce que le cong\u00e9 parental ?<\/h2>\n<p>Le cong\u00e9 parental est un cong\u00e9 th\u00e9matique qui permet \u00e0 un travailleur d\u2019interrompre sa carri\u00e8re, totalement ou partiellement, pour s\u2019occuper de son\/ses jeunes enfant(s).<\/p>\n<p>Il s\u2019agit d\u2019un droit que l\u2019employeur ne peut pas refuser si le travailleur entre dans les conditions d\u2019acc\u00e8s pr\u00e9vues par la r\u00e9glementation. <em>En revanche, dans certains cas, l\u2019employeur peut postposer de maximum 6 mois la prise de cours du cong\u00e9.<\/em><\/p>\n<p>Le travailleur peut b\u00e9n\u00e9ficier d\u2019une allocation d\u2019interruption de l\u2019ONEM. Cette allocation est forfaitaire. Les bar\u00e8mes sont consultables sur <a href=\"https:\/\/www.onem.be\/fr\/documentation\/montants-baremes\/interruption-de-carriere-credit-temps#16311\">le site de l\u2019ONEm<\/a>.<\/p>\n<h2>II. Conditions d&#8217;acc\u00e8s<\/h2>\n<ol>\n<li><strong>Statut<br \/>\n<\/strong>Tous les travailleurs salari\u00e9s occup\u00e9s aupr\u00e8s d\u2019un employeur soumis au droit belge dont la r\u00e9mun\u00e9ration fait l\u2019objet de cotisations sociales.<\/li>\n<\/ol>\n<ol start=\"2\">\n<li><strong>Anciennet\u00e9 chez l\u2019employeur.<\/strong><\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><em>Secteur priv\u00e9<\/em>\u00a0: \u00eatre li\u00e9 par un contrat de travail avec l\u2019employeur pendant 12 mois sur les 15 mois pr\u00e9c\u00e9dant la demande.<\/li>\n<li><em>Secteur public ou enseignement<\/em>\u00a0: pas de condition d\u2019anciennet\u00e9.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong>Lien avec l\u2019enfant<br \/>\n<\/strong>Avoir un lien de parent\u00e9 avec l\u2019enfant pour lequel l\u2019interruption est sollicit\u00e9e.<br \/>\n<em>Cela vise :<\/em><\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><em>la m\u00e8re et le p\u00e8re biologique<\/em><\/li>\n<li><em>la personne qui a reconnu l\u2019enfant de sorte que la filiation paternelle est \u00e9tablie<\/em><\/li>\n<li><em>l\u2019\u00e9pouse ou la compagne de la m\u00e8re biologique qui est devenue co-m\u00e8re<\/em><\/li>\n<li><em>Les parents adoptifs<\/em>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong>Age de l\u2019enfant\u00a0<\/strong><\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>12 ans maximum<\/li>\n<li>21 ans si l\u2019enfant souffre d\u2019un handicap<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>III. Formes d&#8217;interruption<\/h2>\n<ul>\n<li><strong>Interruption compl\u00e8te.<br \/>\n<\/strong>Ouvert \u00e0 tous les travailleurs.<\/li>\n<li><strong>Interruption \u00e0 mi-temps.<br \/>\n<\/strong>Ouvert \u00e0 tous les travailleurs occup\u00e9s \u00e0 temps plein.<\/li>\n<li><strong>Interruption d\u2019un cinqui\u00e8me.<br \/>\n<\/strong>Ouvert \u00e0 tous les travailleurs occup\u00e9s \u00e0 temps plein.<\/li>\n<li><strong>Interruption d\u2019un dixi\u00e8me.<br \/>\n<\/strong>Ouvert \u00e0 tous les travailleurs occup\u00e9s \u00e0 temps plein.<\/li>\n<\/ul>\n<p>Les interruptions partielles n\u00e9cessitent l\u2019accord de l\u2019employeur.<\/p>\n<h2>IV. Dur\u00e9e maximum<\/h2>\n<ul>\n<li><strong>Interruption compl\u00e8te <\/strong>: 4 mois maximum (ou 16 semaines en cas de fractionnement).<\/li>\n<li><strong>Interruption \u00e0 mi-temps <\/strong>: 8 mois maximum.<\/li>\n<li><strong>Interruption d\u2019un cinqui\u00e8me <\/strong>: 20 mois maximum.<\/li>\n<li><strong>Interruption d\u2019un dixi\u00e8me <\/strong>: 40 mois maximum.<\/li>\n<\/ul>\n<h2>V.
