D\u00e9finition<\/h2>\n<p>Les <strong>heures compl\u00e9mentaires<\/strong> sont celles prest\u00e9es par le travailleur \u00e0 temps partiel qui d\u00e9passent la dur\u00e9e de travail convenue sans d\u00e9passer toutefois la dur\u00e9e normale de travail \u00e0 temps plein fix\u00e9e par la loi ou par une C.C.T.<\/p>\n<blockquote>\n<p>Exemple : un travailleur est occup\u00e9 avec un r\u00e9gime de travail de 20h\/semaine. Dans son entreprise, la dur\u00e9e normale de travail est de 38h\/semaine. S\u2019il effectue 25h au cours d\u2019une semaine, on consid\u00e8rera les cinq heures exc\u00e9dentaires comme des heures compl\u00e9mentaires.<\/p>\n<\/blockquote>\n<p>D\u00e8s que le travailleur d\u00e9passe les limites normales de travail temps plein pr\u00e9vues dans l\u2019entreprise, il est consid\u00e9r\u00e9 comme prestant des <strong>heures suppl\u00e9mentaires<\/strong>.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">II. Conditions \u00e0 respecter<\/h2>\n<p>A d\u00e9faut de conditions sp\u00e9cifiques sectorielles d\u00e9termin\u00e9es par C.C.T., la prestation d\u2019heures compl\u00e9mentaires est soumise aux conditions suivantes :<\/p>\n<ul>\n<li>La prestation d\u2019heures compl\u00e9mentaires doit n\u00e9cessairement se faire avec <strong>l\u2019accord du travailleur<\/strong>.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<li>Toute d\u00e9rogation \u00e0 l\u2019horaire pr\u00e9vu doivent <strong>\u00eatre consign\u00e9e<\/strong> soit dans un document pr\u00e9vu \u00e0 cet effet, soit via un syst\u00e8me de pointage.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<li>Si les heures compl\u00e9mentaires sont prest\u00e9es \u00e0 la demande de l\u2019employeur, lorsque le nombre d\u2019heures compl\u00e9mentaires hebdomadaires d\u00e9passe une heure par semaine pendant un trimestre, le travailleur peut demander <strong>l\u2019octroi d\u2019un repos compensatoire<\/strong> pour autant que la dur\u00e9e des heures compl\u00e9mentaires prest\u00e9es pendant le trimestre atteigne en moyenne 20% de l\u2019horaire convenu. Le repos compensatoire doit \u00eatre accord\u00e9 dans les 13 semaines qui suivent le trimestre.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><br \/>\nCette condition ne s&#8217;applique pas lorsque les heures sont prest\u00e9es \u00e0 la demande du travailleur.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<li>Lorsque le nombre d\u2019heures compl\u00e9mentaires hebdomadaires d\u00e9passe une heure par semaine pendant un trimestre, le travailleur peut demander une <strong>adaptation de son contrat de travail<\/strong>.<\/li>\n<\/ul>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">III. Octroi d&#8217;un sursalaire<\/h2>\n<p>A d\u00e9faut d\u2019une CCT contraire ou d&#8217;un accord plus favorable des parties :<\/p>\n<h3 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 18.72; line-height: 1.69; --minfontsize: 18.72;\" data-fontsize=\"18.72\" data-lineheight=\"31.6368px\"><strong>A. Temps partiel fixe \u2013 moins d\u2019un tiers temps :<\/strong><\/h3>\n<p>Les prestations compl\u00e9mentaires sont exclues, sauf si elles pr\u00e9c\u00e8dent ou suivent directement les prestations pr\u00e9vues dans le contrat de travail.<\/p>\n<p>Ces heures donnent toutes droit \u00e0 un sursalaire de 50% (ou 100% en cas de prestations un dimanche ou un jour f\u00e9ri\u00e9).<\/p>\n<h3 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 18.72; line-height: 1.69; --minfontsize: 18.72;\" data-fontsize=\"18.72\" data-lineheight=\"31.6368px\"><strong>B. Temps partiel fixe (horaire fixe ou variable) :<\/strong><\/h3>\n<p>Les prestations compl\u00e9mentaires donnent droit \u00e0 un sursalaire au-del\u00e0 de 12 heures par mois civil.<\/p>\n<h3 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 18.72; line-height: 1.69; --minfontsize: 18.72;\" data-fontsize=\"18.72\" data-lineheight=\"31.6368px\"><strong>C. Temps partiel variable :<\/strong><\/h3>\n<p>Les prestations compl\u00e9mentaires, c\u2019est-\u00e0-dire les heures prest\u00e9es :<\/p>\n<ul>\n<li>en dehors de l\u2019horaire de travail pr\u00e9vu ; ou<\/li>\n<li>dans le cadre de l\u2019horaire pr\u00e9vu, mais au-del\u00e0 de la dur\u00e9e moyenne de travail \u00e0 respecter ;<\/li>\n<\/ul>\n<p>donnent droit \u00e0 un sursalaire au-del\u00e0 d\u2019un cr\u00e9dit de 3h14 par semaine, multipli\u00e9 par le nombre de semaines comprises dans la p\u00e9riode de r\u00e9f\u00e9rence, avec un maximum de 168 heures.<\/p>\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div>\n","protected":false},"featured_media":42222,"template":"","categories":[141],"tags":[830,1505],"class_list":["post-42185","legalconcepts","type-legalconcepts","status-publish","has-post-thumbnail","hentry","category-non-classifiee","tag-contrat-de-travail","tag-ressources-humaines"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
