aria-labelledby=\"toggle_d042cf904c98a5c3b\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Le privil\u00e8ge existe d\u00e8s que, en ex\u00e9cution du contrat de location, les meubles sont introduits<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">dans la maison.<\/span><\/p>\n<blockquote><p>Uniquement en mati\u00e8re de bail et non \u00e0 un autre titre (par exemple, une occupation pr\u00e9caire.\u00a0 Ainsi, le lessor dans une convention de leasing n&#8217;en b\u00e9n\u00e9ficie pas.<\/p><\/blockquote>\n<p>Tout bailleur d&#8217;immeuble, en b\u00e9n\u00e9ficie,\u00a0 tant qu&#8217;il demeure bailleur\u00a0 :<\/p>\n<ul>\n<li>quelle que soit sa qualit\u00e9 (propri\u00e9taire, usufruitier, locataire, etc.)<\/li>\n<li>quel que soit cet immeuble (habitation, immeuble \u00e0 usage commercial ou industriel, ferme, etc.)<\/li>\n<\/ul>\n<blockquote><p>Le loyer aff\u00e9rent \u00e0 des meubles n&#8217;est pas couvert par le privil\u00e8ge, sauf si ces meubles sont immeubles par destination.<\/p><\/blockquote>\n<p>Cela ne concerne que les cr\u00e9ances d\u00e9coulant du bail.<\/p>\n<blockquote><p>Notamment les r\u00e9parations locatives, les contributions et tax\u00e9s, les pertes et d\u00e9gradition, les int\u00e9r\u00eats de retard, les indemnit\u00e9s de r\u00e9siliation ou de relocation.<\/p><\/blockquote>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-177fb999bf06e66c7 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_177fb999bf06e66c7\"><a aria-expanded=\"false\" aria-controls=\"177fb999bf06e66c7\" role=\"button\" data-toggle=\"collapse\" <\/span><\/a><\/h4><\/div><div id=\"177fb999bf06e66c7\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_177fb999bf06e66c7\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Le privil\u00e8ge s\u2019exerce sur le prix :<\/span><\/p>\n<ul>\n<li><span dir=\"ltr\" role=\"presentation\">des fruits de la r\u00e9colte de l\u2019ann\u00e9e ;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">de tout ce qui garnit la maison lou\u00e9e ou la ferme ;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">de tout ce qui sert \u00e0 l\u2019exploitation de la ferme.<\/span><\/li>\n<\/ul>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-4b5c1564b4ec351e1 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_4b5c1564b4ec351e1\"><a aria-expanded=\"false\" aria-controls=\"4b5c1564b4ec351e1\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-43559-1\" data-target=\"#4b5c1564b4ec351e1\" href=\"#4b5c1564b4ec351e1\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Questions particuli\u00e8res concernant les meubles<\/span><\/a><\/h4><\/div><div id=\"4b5c1564b4ec351e1\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_4b5c1564b4ec351e1\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p><span style=\"text-decoration: underline;\">1. Cela concerne tous les meubles?\u00a0<\/span><\/p>\n<p>L&#8217;assiette est tr\u00e8s large et couvre, outre les meubles meubles, par exemple, les objets, outils et marchandises n\u00e9cessaires \u00e0 l&#8217;exercice d&#8217;un commerce ainsi que les machines et outils plac\u00e9s dans une usine, y compris les biens lou\u00e9s en leasing.<\/p>\n<blockquote><p>Certains biens sont n\u00e9anmoins exclus, comme les meubles insaisissables en vertu d&#8217;une disposition l\u00e9gale,\u00a0 les biens incorporels comme la client\u00e8le, les bijoux ou les obligations.<\/p><\/blockquote>\n<p><span style=\"text-decoration: underline;\">2.\u00a0 Remplacement\u00a0<\/span><\/p>\n<p>Si les biens sont vendus, le privil\u00e8ge du bailleur se reporte sur la valeur de ces biens.<\/p>\n<p>Les indemnit\u00e9s (d&#8217;assurance) per\u00e7ues par le preneur en cas de perte des meubles doivent \u00eatre affect\u00e9es au paiement des cr\u00e9ances du bailleur, si celles-ci ne sont pas employ\u00e9es au remplacement des meubles.(Voir article 10 de la loi hypoth\u00e9caire).<\/p>\n<p>Nonobstant le d\u00e9placement de meubles, le privil\u00e8ge reste opposable au curateur si une saisie-gagerie a \u00e9t\u00e9 pr\u00e9alablement effectu\u00e9e.<\/p>\n<p><span style=\"text-decoration: underline;\">3. Qu&#8217;en est il des meubles appartenant \u00e0 des tiers ?\u00a0<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Ces meubles font \u00e9galement l&#8217;objet du privil\u00e8ge, par principe. \u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">Le Bailleur ne doit donc pas rechercher si le mobilier appartient ou non au preneur.\u00a0\u00a0<\/span><\/p>\n<p>Ce n&#8217;est que si le bailleur savait, au moment o\u00f9 les biens sont rentr\u00e9s dans les lieux, qu&#8217;ils n&#8217;appartenaient pas au locataire que ceux-ci \u00e9chappent au privil\u00e8ge.\u00a0 \u00a0Cette preuve peut-\u00eatre apport\u00e9e par des pr\u00e9somptions, le cas \u00e9ch\u00e9ant.<\/p>\n<p>En ce qui concerne le <strong>sous-locataire<\/strong> dont la sous-location a \u00e9t\u00e9 <strong>autoris\u00e9<\/strong>e, le privil\u00e8ge du bailleur est limit\u00e9 \u00e0 concurrence du prix de la sous-location dont il est d\u00e9biteur au moment de la saisie.\u00a0 Il ne peut en principe pas opposer des paiements faits par anticipation (C. Civ. art. 1753 et C. Jud, art. 146, al 2).\u00a0 Si la sous-location n&#8217;est pas autoris\u00e9e, le sous-locataire reste un tiers \u00e0 part enti\u00e8re, et il devra donc prouver <span dir=\"ltr\" role=\"presentation\">qu\u2019au moment de leur transport dans<\/span><span dir=\"ltr\" role=\"presentation\">l\u2019immeuble, le bailleur n\u2019ignorait pas que ceux-ci n\u2019\u00e9taient pas la propri\u00e9t\u00e9 du preneur principal.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-8488b650e2803609b fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_8488b650e2803609b\"><a aria-expanded=\"false\" aria-controls=\"8488b650e2803609b\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-43559-1\" data-target=\"#8488b650e2803609b\" href=\"#8488b650e2803609b\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Concours avec d'autres privil\u00e8ges <\/span><\/a><\/h4><\/div><div id=\"8488b650e2803609b\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_8488b650e2803609b\"><div class=\"panel-body toggle-content fusion-clearfix\"><\/p>\n<p>Le privil\u00e8ge du bailleur c\u00e8de le pas aux superprivil\u00e8ges suivants:<\/p>\n<ul>\n<li>celui concernant les frais de justice (article 21 LH);<\/li>\n<li>celui de l\u2019assureur (articles 114 et 247 de la loi du 4 avril 2014),<\/li>\n<li>ceux relatifs aux frais pour la conservation de la chose, \u00e0 savoir les frais r\u00e9alis\u00e9s sur un ou plusieurs biens garnissant les lieux (article 22 L.H.),<\/li>\n<li>et celui relatif aux frais fun\u00e9raires (article 25 L.H.).<\/li>\n<\/ul>\n<p><span dir=\"ltr\" role=\"presentation\">Le conflit entre le privil\u00e8ge du bailleur et le <\/span><span dir=\"ltr\" role=\"presentation\">gage sur fonds de commerce est r\u00e9gl\u00e9 par l\u2019ant\u00e9riorit\u00e9<\/span><span dir=\"ltr\" role=\"presentation\">.\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">Il prend rang au moment o\u00f9 la convention de bail re\u00e7oit ex\u00e9cution (et o\u00f9 les meubles sont introduits dans les lieux lou\u00e9s) et reste subsister et main<\/span><span dir=\"ltr\" role=\"presentation\">tient son rang m\u00eame s\u2019il y a eu des conventions successives de baux entre parties.\u00a0 E<\/span>n ce qui concerne le gage, ce dernier prend rend \u00e0 la date de son enregistrement au registre des gages.<\/p>\n<p>Le privil\u00e8ge du bailleur pr\u00e9vaut normalement contre le privil\u00e8ge ou la s\u00fbret\u00e9 du vendeur impay\u00e9\u00a0 sauf si le bailleur est imm\u00e9diatement inform\u00e9 par le bailleur du fait que le bien vendu reste impay\u00e9 (article 23 LH) (Il peut en alller diff\u00e9remment en cas de conflit avec un gage sur fond de commerce qui lui est ant\u00e9rieur, auquel cas la superpriorit\u00e9 dont b\u00e9n\u00e9ficie le vendeur impay\u00e9 primerait le privil\u00e8ge du bailleur).\u00a0 Il convient de suivre l&#8217;\u00e9volution de la jurisprudence sur ce point. <\/div><\/div><\/div> <\/div><\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"featured_media":0,"template":"","categories":[],"tags":[],"class_list":["post-43559","legalconcepts","type-legalconcepts","status-publish","hentry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Le privil\u00e8ge du bailleur - e2.law<\/title>\n<meta name=\"robots\" content=\"index, follow, max-snippet:-1, max-image-preview:large, max-video-preview:-1\" \/>\n<link rel=\"canonical\" href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/le-privilege-du-bailleur\/\" \/>\n<meta property=\"og:locale\" content=\"fr_FR\" \/>\n<meta property=\"og:type\" content=\"article\" \/>\n<meta property=\"og:title\" content=\"Le privil\u00e8ge du bailleur - e2.law\" \/>\n<meta property=\"og:description\" content=\"&nbsp;
