{"id":43572,"date":"2023-01-22T15:07:49","date_gmt":"2023-01-22T13:07:49","guid":{"rendered":"https:\/\/www.e2.law\/?post_type=legalconcepts&#038;p=43572"},"modified":"2023-01-22T15:40:01","modified_gmt":"2023-01-22T13:40:01","slug":"sous-location","status":"publish","type":"legalconcepts","link":"https:\/\/www.e2.law\/fr\/legalconcepts\/sous-location\/","title":{"rendered":"Sous-location"},"content":{"rendered":"<p><span dir=\"ltr\" role=\"presentation\">La sous-location est un bail distinct du bail principal par lequel le preneur du bail principal<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">sous-loue tout ou une partie du bien lou\u00e9 \u00e0 un sous-locataire.\u00a0 \u00a0<\/span><\/p>\n<p>La sous-location peut porter sur l&#8217;ensemble ou sur une partie des biens lou\u00e9s.<\/p>\n<p>En droit commun, si le bail ne l&#8217;interdit pas, la sous-location est autoris\u00e9e.\u00a0 \u00a0Des r\u00e8gles particuli\u00e8res existent pour les baux de r\u00e9sidence principale, \u00e0 ferme ou commercial.<\/p>\n<p><span dir=\"ltr\" role=\"presentation\">En voici les effets en droit commun, pour autant que le contrat n&#8217;y d\u00e9roge pas. <\/span><\/p>\n<ul>\n<li><span dir=\"ltr\" role=\"presentation\">Le bailleur principal reste \u00e9tranger au bail de sous-location.\u00a0 <\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">Quant au preneur principal, il se trouve \u00e0 la fois locataire (bail principal) et bailleur (bail de sous-location).<\/span><\/li>\n<\/ul>\n<p>Ceci a les implications suivantes:<\/p>\n<ul>\n<li>\u00a0<em>Entre bailleur et preneur principal:<\/em> Aucune modification (le preneur reste tenu envers le bailleur de toutes les obligations du bail et doit assumer ses agissements mais \u00e9galement r\u00e9pondre de ceux du sous-locataire).<\/li>\n<li><em>Entre locataire principal et sous-locataire: <\/em>\u00a0il existe un bail \u00e0 part enti\u00e8re, impliquant que le sous-locataire peut exiger du locataire principal le respect de toutes les obligations reposant normalement sur le bailleur. Dans le mesure o\u00f9 le preneur principal ne peut conf\u00e9rer plus de droit qu&#8217;il n&#8217;en a lui-m\u00eame, le bail de sous-location suivra g\u00e9n\u00e9ralement le bail principal.<\/li>\n<li><em>Entre bailleur principal et sous-locataire:\u00a0 \u00a0<\/em>\n<ul>\n<li>il n&#8217;existe aucune relation contractuelle entre ceux-ci, qui ne disposent l&#8217;un envers l&#8217;autre d&#8217;aucune action directe.
