Il ne rend le travailleur qu\u2019exceptionnellement responsable des fautes qu\u2019il commet dans l\u2019ex\u00e9cution de son contrat de travail.<\/p>\n<p><a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/loi_a1.pl?cn=1978070301&amp;la=F&amp;language=fr&amp;table_name=loi&amp;&amp;caller=list&amp;F&amp;fromtab=loi&amp;tri=dd+AS+RANK&amp;rech=1&amp;numero=1&amp;sql=(text+contains+(%27%27))#Art.18\">L\u2019article 18 de la loi du 3 juillet 1978 relative aux contrats de travail<\/a> pr\u00e9voit en effet qu\u2019en cas de dommage caus\u00e9 \u00e0 l\u2019employeur ou \u00e0 un tiers par le travailleur dans l\u2019ex\u00e9cution de son contrat de travail, il ne r\u00e9pond que de son dol, de sa faute lourde et de sa faute l\u00e9g\u00e8re habituelle. Cet article instaure une <strong>immunit\u00e9 de responsabilit\u00e9<\/strong>. Puisqu\u2019il d\u00e9roge au r\u00e9gime commun, il doit \u00eatre appr\u00e9ci\u00e9 strictement.<\/p>\n<p>Sur le plan p\u00e9nal, le travailleur reste soumis au droit commun. Aux travailleurs<\/h3>\n<ul>\n<li>Aux travailleurs li\u00e9s par un contrat de travail au sens de l\u2019article 1er de la loi du 3 juillet 1978, c\u2019est-\u00e0-dire les :\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>ouvriers<\/li>\n<li>employ\u00e9s<\/li>\n<li>repr\u00e9sentants de commerce<\/li>\n<li>domestiques<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>Aux travailleurs occup\u00e9s par l\u2019Etat, les provinces, les agglom\u00e9rations, les f\u00e9d\u00e9rations de communes, les communes, les \u00e9tablissements publics qui en d\u00e9pendent, les organismes d\u2019int\u00e9r\u00eat public et les \u00e9tablissements d\u2019enseignement libre subventionn\u00e9s par l\u2019Etat<\/li>\n<li>Aux travailleurs li\u00e9s par un contrat de travail en droit \u00e9tranger qui commettent un acte dommageable en Belgique<\/li>\n<\/ul>\n<div>Il ne s\u2019applique pas aux:<\/div>\n<ul>\n<li>travailleurs ind\u00e9pendants<\/li>\n<li>b\u00e9n\u00e9voles<\/li>\n<li>travailleurs associatifs du secteur sportif<\/li>\n<li>apprentis industriels ou en contrat d\u2019alternance<\/li>\n<li>stagiaires<\/li>\n<li>travailleurs soumis \u00e0 des tests conform\u00e9ment \u00e0 la CCT n\u00b038 sur le recrutement et la s\u00e9lection des travailleurs<\/li>\n<li>agents des pouvoirs publics lorsqu\u2019ils sont soumis \u00e0 un r\u00e9gime statutaire.<\/li>\n<\/ul>\n<blockquote>\n<div>Note : certains de ces travailleurs b\u00e9n\u00e9ficient d\u2019une immunit\u00e9 similaire en application de lois particuli\u00e8res. Par exemple, l\u2019article 21 de la loi du 24 d\u00e9cembre 2020 relative au travail associatif ou l\u2019article 19 de la loi du 19 \u00a0juillet 1983 sur l\u2019apprentissage de profession.<\/div>\n<\/blockquote>\n<h3>2. Dans l\u2019ex\u00e9cution du contrat de travail<\/h3>\n<p>L\u2019article 18 n\u2019att\u00e9nue la responsabilit\u00e9 du travailleur que pour les actes commis dans l\u2019ex\u00e9cution de son contrat de travail.<\/p>\n<p>Tout acte commis en dehors de l\u2019ex\u00e9cution de son contrat de travail reste soumis au droit commun de la responsabilit\u00e9 civile. Par exemple, un travailleur qui viole un accord de non-concurrence apr\u00e8s la rupture de son contrat de travail ne peut pas se pr\u00e9valoir de l\u2019article 18.<\/p>\n<div>La Cour de cassation donne une port\u00e9e particuli\u00e8rement large aux termes \u00ab dans l\u2019ex\u00e9cution de son contrat \u00bb. Il suffit que l\u2019acte entre dans les fonctions du pr\u00e9pos\u00e9, qu\u2019il ait \u00e9t\u00e9 accompli pendant la dur\u00e9e des fonctions et soit, m\u00eame indirectement ou occasionnellement, en relation avec celles-ci.<\/div>\n<div><\/div>\n<h3>3. Exigence d\u2019une faute sp\u00e9cifique<\/h3>\n<p>Lorsque le travailleur commet un dol, une faute lourde ou une faute l\u00e9g\u00e8re habituelle, il ne b\u00e9n\u00e9ficie plus de la protection de l\u2019article 18.<\/p>\n<ul>\n<li><strong>Le dol<\/strong> : faute commise dans le but de causer un dommage.<\/li>\n<li><strong>La faute lourde<\/strong> : faute non-intentionnelle mais \u00e0 ce point grossi\u00e8re et d\u00e9mesur\u00e9e qu\u2019elle ne peut se comprendre d\u2019une personne raisonnable.<\/li>\n<li><strong>La faute l\u00e9g\u00e8re habituelle<\/strong> : une r\u00e9p\u00e9tition consciente de fautes excusables (fautes qu\u2019une personne normalement prudente et avis\u00e9e, plac\u00e9e dans les m\u00eames circonstances, commettrait sans doute) de m\u00eame nature.<\/li>\n<\/ul>\n<h3>4. Exigence d\u2019un dommage<\/h3>\n<div>La responsabilit\u00e9 du travailleur ne peut \u00eatre engag\u00e9e que si son dol, sa faute lourde ou l\u00e9g\u00e8re habituelle cause un dommage \u00e0 l\u2019employeur ou \u00e0 un tiers.<\/div>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-7e322e542f78b4e0e fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_7e322e542f78b4e0e\"><a aria-expanded=\"false\" aria-controls=\"7e322e542f78b4e0e\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-32254-1\" data-target=\"#7e322e542f78b4e0e\" href=\"#7e322e542f78b4e0e\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">D\u00e9rogations<\/span><\/a><\/h4><\/div><div id=\"7e322e542f78b4e0e\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_7e322e542f78b4e0e\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Seule une convention collective de travail rendue obligatoire par le Roi peut d\u00e9roger \u00e0 l\u2019article 18. Une clause dans le contrat de travail ou le r\u00e8glement de travail qui contiendrait une telle d\u00e9rogation serait nulle.<\/p>\n<p>L\u2019article 107 de la loi du 3 juillet 1978 permet n\u00e9anmoins \u00e0 l\u2019employeur de mettre \u00e0 charge d\u2019un repr\u00e9sentant de commerce une responsabilit\u00e9 du chef de l\u2019insolvabilit\u00e9 de ses clients, dans certaines limites par le biais d\u2019une\u00a0<a href=\"https:\/\/www.e2.law\/fr\/clauses\/clause-de-ducroire\/\">clause de ducroire<\/a>.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-text fusion-text-2\"><h2>I. Envers l&#8217;employeur<\/h2>\n<p>Le travailleur n\u2019est donc pas responsable lorsqu\u2019il occasionne, par sa faute l\u00e9g\u00e8re, un pr\u00e9judice \u00e0 son employeur.<\/p>\n<p>Les obligations auxquelles le travailleur est tenu sont principalement d&#8217;une\u00a0<a href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/obligation-de-moyens\/\">obligation de moyens<\/a>, et non d&#8217;une <a href=\"https:\/\/www.e2.law\/fr\/legalconcepts\/obligation-de-resultat\/\">obligation de r\u00e9sultat<\/a>.<\/p>\n<blockquote>\n<p>La simple constatation que le travailleur ait d\u00e9grad\u00e9 le mat\u00e9riel, commis une erreur d\u2019encodage ou qu\u2019il y ait une erreur de caisse ne suffit pas \u00e0 d\u00e9montrer qu\u2019il a commis une faute.<\/p>\n<\/blockquote>\n<div>Pour voir la responsabilit\u00e9 du travailleur engag\u00e9, l\u2019employeur devra donc :<\/div>\n<ol>\n<li>prouver qu\u2019il n\u2019a pas mis en \u0153uvre tous les moyens raisonnables pour ex\u00e9cuter l\u2019obligation qui pesait sur lui comme l\u2019aurait fait tout travailleur raisonnablement prudent et diligent ; et<\/li>\n<li>prouver que la faute commise est soit une faute lourde, soit une faute l\u00e9g\u00e8re habituelle, soit un dol.<\/li>\n<\/ol>\n<h2>II. Envers un tiers<\/h2>\n<p>L\u2019article 18 att\u00e9nue \u00e9galement la responsabilit\u00e9 civile du travailleur \u00e0 l\u2019\u00e9gard des tiers.<\/p>\n<p>Elle n\u2019alt\u00e8re en revanche pas la responsabilit\u00e9 de l\u2019employeur, en tant que commettant, pour les dommages caus\u00e9s par ses pr\u00e9pos\u00e9s.
