Choix du m\u00e9decin<\/h2>\n<p>Le choix du m\u00e9decin, dit \u00ab\u00a0<strong>m\u00e9decin-contr\u00f4leur<\/strong>\u00a0\u00bb, est laiss\u00e9 \u00e0 l\u2019employeur, pour autant qu\u2019il remplisse les conditions suivantes\u00a0:<\/p>\n<ul>\n<li>\u00eatre autoris\u00e9 \u00e0 pratiquer la m\u00e9decine\u00a0;<\/li>\n<li>avoir au moins 5 ans d\u2019exp\u00e9rience comme m\u00e9decin g\u00e9n\u00e9raliste ou \u00e9quivalent ; et<\/li>\n<li>avoir sign\u00e9 une d\u00e9claration d\u2019ind\u00e9pendance (un mod\u00e8le est annex\u00e9 \u00e0 <a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi\/article_body.pl?language=fr&amp;caller=summary&amp;pub_date=01-08-03&amp;numac=2001012681\">l\u2019A.R. du 18 juillet 2001<\/a>).<\/li>\n<\/ul>\n<h2>II. Moment du contr\u00f4le<\/h2>\n<p>Le contr\u00f4le peut \u00eatre effectu\u00e9 <strong>pendant toute la p\u00e9riode d\u2019absence<\/strong> du travailleur, m\u00eame au-del\u00e0 de la p\u00e9riode couverte par le salaire garanti.<\/p>\n<h2>III. Modalit\u00e9s de contr\u00f4le<\/h2>\n<p>Le travailleur re\u00e7oit une invitation \u00e0 se pr\u00e9senter chez le m\u00e9decin-contr\u00f4leur dans un certain d\u00e9lai. <strong>Il ne peut refuser de s\u2019y rendre<\/strong> et de se laisser examiner par ce dernier.<\/p>\n<p><strong>Si le travailleur se soustrait au contr\u00f4le<\/strong> sans motif l\u00e9gitime, l\u2019employeur peut refuser le paiement du salaire garanti pour les jours d\u2019incapacit\u00e9 qui pr\u00e9c\u00e8dent le jour du contr\u00f4le. D\u00e8s que le travailleur se soumet au contr\u00f4le, il retrouve son droit au salaire garanti.<\/p>\n<p>Les frais de d\u00e9placement sont \u00e0 charge de l\u2019employeur.<\/p>\n<h2>IV. Objet du contr\u00f4le<\/h2>\n<p>Le m\u00e9decin-contr\u00f4le examine\u00a0:<\/p>\n<ul>\n<li><strong>la r\u00e9alit\u00e9<\/strong> de l\u2019incapacit\u00e9\u00a0;<\/li>\n<li><strong>la dur\u00e9e probable<\/strong> de l\u2019incapacit\u00e9\u00a0; et<\/li>\n<li>le cas \u00e9ch\u00e9ant, les autres donn\u00e9es m\u00e9dicales n\u00e9cessaires \u00e0 l\u2019application de la loi.<\/li>\n<\/ul>\n<p>Le m\u00e9decin-contr\u00f4leur peut, si n\u00e9cessaire, consulter le m\u00e9decin qui a d\u00e9livr\u00e9 le certificat m\u00e9dical au travailleur.<\/p>\n<p>Il remet ses <strong>constatations \u00e9crites<\/strong> au travailleur. Si le travailleur est en d\u00e9saccord avec les constatations \u00e9crites du m\u00e9decin-contr\u00f4leur, il doit l\u2019en informer par \u00e9crit. Le m\u00e9decin-contr\u00f4leur actera le d\u00e9saccord dans son rapport.<\/p>\n<p>Si le m\u00e9decin-contr\u00f4leur estime le travailleur apte au travail, <strong>les deux constatations m\u00e9dicales s\u2019annulent mutuellement<\/strong>. Elles sont consid\u00e9r\u00e9es comme \u00e9quivalentes. Ceci emporte les cons\u00e9quences suivantes\u00a0:<\/p>\n<ul>\n<li>le travailleur ne peut plus pr\u00e9tendre au salaire garanti puisqu\u2019il n\u2019\u00e9tablit pas de mani\u00e8re certaine son incapacit\u00e9\u00a0;<\/li>\n<li>l\u2019employeur ne peut invoquer un motif grave de licenciement puisqu\u2019il ne peut prouver le caract\u00e8re ill\u00e9gitime de l\u2019absence.<\/li>\n<\/ul>\n<p>La partie la plus diligente saisira soit les juridictions du travail, soit recourront \u00e0 la proc\u00e9dure d\u2019arbitrage pr\u00e9vue par <a href=\"https:\/\/www.ejustice.just.fgov.be\/eli\/loi\/1978\/07\/03\/1978070303\/justel#Art.31\">l\u2019article 31,\u00a75 de la loi relative aux contrats de travail<\/a>.<\/p>\n<h2>V. Recours \u00e0 la proc\u00e9dure d&#8217;arbitrage<\/h2>\n<p>En cas de litige, la partie la plus diligente peut faire appel \u00e0 un <strong>m\u00e9decin-arbitre<\/strong>. Ce dernier doit \u00eatre d\u00e9sign\u00e9 de commun accord par les parties.<\/p>\n<p>Si les parties ne parviennent pas \u00e0 se mettre d\u2019accord dans un d\u00e9lai de deux jours ouvrables, l\u2019une d\u2019entre elle peut d\u00e9signer un m\u00e9decin-arbitre repris dans une <a href=\"https:\/\/emploi.belgique.be\/fr\/agrements\/la-medecine-de-controle-liste-des-medecins-arbitres\">liste \u00e9tablie par le SPF emploi, travail et concertation sociale<\/a>.<\/p>\n<p>Le m\u00e9decin-arbitre statue dans les trois jours qui suivent sa d\u00e9signation.
