R\u00e9ponse ci-dessous.<\/p>\n<p><em>Cet article s&#8217;applique uniquement pour les contrats entr\u00e9s en vigueur apr\u00e8s le 1er janvier 2014. Pour tout contrat entr\u00e9 en vigueur avant cette date, n&#8217;h\u00e9sitez pas \u00e0 nous contacter.<\/em><\/p>\n<h2>I. Prise de cours du pr\u00e9avis<\/h2>\n<p>Le d\u00e9lai de pr\u00e9avis d\u00e9bute toujours <strong>le premier lundi qui suit le jour o\u00f9 la lettre de pr\u00e9avis est cens\u00e9e avoir \u00e9t\u00e9 r\u00e9ceptionn\u00e9e<\/strong>, m\u00eame si ce lundi est un jour f\u00e9ri\u00e9.<\/p>\n<ul>\n<li>La notification envoy\u00e9e par courrier recommand\u00e9 est cens\u00e9 \u00eatre re\u00e7ue le troisi\u00e8me jour ouvrable qui suit la date d&#8217;envoi.<\/li>\n<li>Le pr\u00e9avis signifi\u00e9 par exploit de huissier est cens\u00e9 \u00eatre re\u00e7u le jour de la signification.<\/li>\n<li>La notification remise en main propre par l&#8217;employ\u00e9 \u00e0 son employeur cens\u00e9 \u00eatre re\u00e7u le jour de la remise.<\/li>\n<\/ul>\n<p>Pour plus d&#8217;information sur la notification du pr\u00e9avis, rendez-vous sur l&#8217;article d\u00e9di\u00e9 <a href=\"https:\/\/www.e2.law\/fr\/needs\/notifier-une-rupture-de-contrat-de-travail-avec-preavis\/\">en cliquant ici<\/a>.<\/p>\n<h2>II. D\u00e9terminer l&#8217;anciennet\u00e9 du travailleur<\/h2>\n<p>Le d\u00e9lai de pr\u00e9avis est calcul\u00e9 en fonction de<strong> l&#8217;anciennet\u00e9 du travailleur<\/strong>.<\/p>\n<blockquote><p>L\u2019<strong>anciennet\u00e9<\/strong> s\u2019entend comme la p\u00e9riode pendant laquelle le travailleur est demeur\u00e9 sans interruption au service de la m\u00eame entreprise. Peu importe qu&#8217;il s&#8217;agisse d&#8217;un seul contrat ou de plusieurs contrats distincts successifs.<\/p>\n<p>S&#8217;il y a eu une interruption r\u00e9elle et effective des prestations, la p\u00e9riode ant\u00e9rieure \u00e0 l&#8217;interruption et l&#8217;interruption elle-m\u00eame ne sont pas compt\u00e9es dans ce calcul.<\/p><\/blockquote>\n<p>Elle se calcule de la date du d\u00e9but des prestations \u00e0 :<\/p>\n<ul>\n<li>la veille du jour o\u00f9 le pr\u00e9avis prend cours <strong>en cas de rupture avec pr\u00e9avis<\/strong> ; et<\/li>\n<li>le jour de la rupture effective du contrat <strong>en cas de rupture imm\u00e9diate<\/strong>.<\/li>\n<\/ul>\n<h2>III. Dur\u00e9e du pr\u00e9avis<\/h2>\n<p>Depuis le 1er janvier 2014, les m\u00eames d\u00e9lais de pr\u00e9avis s&#8217;appliquent \u00e0 tous les travailleurs, qu&#8217;ils soient ouvriers ou employ\u00e9s. Ces d\u00e9lais sont d\u00e9termin\u00e9s par la loi.
