La <a href=\"https:\/\/www.e2.law\/fr\/laws\/loi-du-30-avril-1951-relative-aux-baux-commerciaux\/\">loi du 30 avril 1951 relative aux baux commerciaux<\/a> pr\u00e9voit n\u00e9anmoins plusieurs hypoth\u00e8ses de r\u00e9siliation anticip\u00e9e.<\/p>\n<p>Rien n&#8217;emp\u00eache les parties de pr\u00e9voir une dur\u00e9e plus longue en faveur du locataire. Dans ce cas, le bail devra \u00eatre conclu par acte authentique <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>. A d\u00e9faut, la dur\u00e9e du bail commercial ne sera pas opposable aux tiers, par exemple l&#8217;acqu\u00e9reur du bien lou\u00e9. Le bail pourra alors \u00eatre ramen\u00e9 \u00e0 une dur\u00e9e \u00e0 neuf ans.<\/p>\n<p style=\"color: #ffffff;\">.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">I. R\u00e9siliation par le preneur<\/h2>\n<p><a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi_loi\/loi_a1.pl?language=fr&amp;la=F&amp;table_name=loi&amp;cn=1951043030&amp;&amp;caller=list&amp;F&amp;fromtab=loi&amp;tri=dd+AS+RANK&amp;rech=1&amp;numero=1&amp;sql=(text+contains+(%27%27))#Art.3\">L&#8217;article 3, alin\u00e9a 3 de la loi de 1951<\/a> pr\u00e9voit la possibilit\u00e9 pour le preneur de mettre fin au bail commmercial \u00e0 l&#8217;issue de chaque triennat moyennant le respect d&#8217;un pr\u00e9avis de six mois.<\/p>\n<p>Pour \u00eatre valablement communiqu\u00e9, le pr\u00e9avis doit \u00eatre notifi\u00e9 :<\/p>\n<ul>\n<li>par exploit d&#8217;huissier ; ou<\/li>\n<li>par lettre recommand\u00e9e.<\/li>\n<\/ul>\n<p>Le preneur n&#8217;a aucune obligation de justifier les motifs de la r\u00e9siliation.<\/p>\n<p>Le contrat de bail ne peut d\u00e9roger \u00e0 cette disposition qu&#8217;en faveur du preneur. La clause par laquelle le preneur renonce \u00e0 la facult\u00e9 de r\u00e9silier le bail \u00e0 l&#8217;issue de chaque triennat est nulle. En revanche, la clause qui permet au preneur de r\u00e9silier le bail en tout temps ou moyennant un d\u00e9lai de pr\u00e9avis plus court que celui pr\u00e9vu dans la loi est valable.<\/p>\n<p style=\"color: #ffffff;\">.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">II. R\u00e9siliation par le bailleur<\/h2>\n<p>Pour autant que le contrat de bail l&#8217;y autorise express\u00e9ment, le bailleur peut mettre fin au bail \u00e0 l&#8217;issue de chaque triennat moyennant un pr\u00e9avis d&#8217;un an pour y exploiter lui-m\u00eame un commerce ou pour permettre l&#8217;exploitation d&#8217;un commerce par l&#8217;une des personnes suivantes :<\/p>\n<ul>\n<li>son conjoint ;<\/li>\n<li>les ascendants, descendants et enfants adoptifs du bailleur et\/ou de son conjoint ;<\/li>\n<li>\u00a0une soci\u00e9t\u00e9 de personnes dont les associ\u00e9s actifs ou les associ\u00e9s poss\u00e9dant au moins les trois quarts du capital ont avec le bailleur ou son conjoint les m\u00eames relations de parent\u00e9, d\u2019alliance ou d\u2019adoption.<\/li>\n<\/ul>\n<p>La clause doit mentionner <u>toutes<\/u> les conditions pr\u00e9vues par l\u2019article 3, al. 4. A d\u00e9faut, elle pourra \u00eatre \u00e9cart\u00e9e par le juge <a href=\"#_ftn1\" name=\"_ftnref1\">[2]<\/a>. Elle ne peut se contenter de pr\u00e9voir la possibilit\u00e9 de r\u00e9siliation par le bailleur \u00e0 l&#8217;expiration de chaque triennat, elle doit reprendre textuellement toutes les conditions \u00e9nonc\u00e9es dans la loi.<\/p>\n<p>Pour b\u00e9n\u00e9ficier de l&#8217;autorisation de r\u00e9siliation, la personne doit effectivement exploiter un commerce dans les lieux dans les six mois du d\u00e9part du preneur et pendant une dur\u00e9e d&#8217;au moins deux ans. A d\u00e9faut, le bailleur sera redevable d&#8217;une indemnit\u00e9 d&#8217;\u00e9viction \u00e9quivalente \u00e0 minimum trois ans de loyers \u00e0 moins qu&#8217;il ne justifie d&#8217;un motif grave <a href=\"#_ftn1\" name=\"_ftnref1\">[3].<\/a><\/p>\n<p style=\"color: #ffffff;\">.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">III. R\u00e9siliation de commun accord<\/h2>\n<p>Les parties peuvent mettre fin au bail de commun accord \u00e0 tout moment :<\/p>\n<ul>\n<li>A Bruxelles et en Flandre, l&#8217;accord des parties doit \u00eatre constat\u00e9 dans un acte authentique, ou par jugement <a href=\"#_ftn1\" name=\"_ftnref1\">[4]<\/a>.<br \/>\nCe jugement peut \u00eatre notamment obtenu par une proc\u00e9dure de conciliation devant le juge de paix.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<li>En Wallonie, depuis le 7 avril 2018, un simple \u00e9crit pr\u00e9sent\u00e9 \u00e0 l&#8217;enregistrement suffit <a href=\"#_ftn2\" name=\"_ftnref2\">[5]<\/a>.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/li>\n<\/ul>\n<h2 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 24; line-height: 1.5;\" data-fontsize=\"24\" data-lineheight=\"36px\">IV. Sort du bail commercial \u00e0 l&#8217;issue de la p\u00e9riode de 9 ans<\/h2>\n<p>Le bail commercial est toujours un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e (hormis le cas de la tacite reconduction).
